Promotion-- Non-Availability of ACRs Due to Wrongful Discharge -- Consequential Benefits to Judicial Officer -- Where the non-availability of requisite ACRs is attributable to the employer, entitlement of the employee to promotion or pay in question is assessed on the basis of the remaining valid ACRs. An employer cannot rely on a shortcoming created by its own wrongful action to deny consequential service benefits, since the law does not permit a party to derive advantage from its own wrong.
