Permanent Absorption in New Cadre -- Financial Benefits of Earlier Cadre Cannot Be Withheld

Constitution of India, Art.14 -- Service Law -- Permanent Absorption in New Cadre -- Upon permanent absorption in a cadre, an employee becomes a member of that cadre for all service purposes. The lien on the earlier post and the incidents of the earlier cadre cease to govern service conditions. All rights, promotional avenues and financial benefits thereafter become regulated by the service rules of the cadre of absorption, and denial of such benefits on the ground of initial appointment in a different cadre is arbitrary and violative of Article 14.
