Assam Services (Pension) Rules, 1969, R.143 -- Family Pension to Wife -- Nomination of Another Woman -- Entitlement to family pension flows from the statutory scheme and not from nomination made by the deceased employee. A nomination is only an administrative arrangement facilitating payment and cannot enlarge or create substantive rights in favour of a person otherwise not entitled under the Rules. Family pension is a statutory benefit for the surviving family and cannot be defeated by unilateral nomination.
