Guardian and Wards Act, 1890, S.25 -- Custody of Minor Child -- Breach of Foreign Custody Order by Mother -- Violation of conditions imposed by a foreign court or by the domestic court does not by itself disentitle a mother to custody, if continued custody with her otherwise serves the best interests and welfare of the children. Greater economic prosperity of the father is not a guarantee of welfare of a minor and does not disturb the presumption favouring the mother. Standard of living of a parent alone cannot determine custody.
