Quashing of Criminal Proceedings -- Post-Conviction Compromise -- Permissible in non-heinous offences not affecting society at large

Criminal Procedure Code, 1973, S.482 -- Quashing of Criminal Proceedings -- Post-Conviction Compromise -- High Courts may quash criminal proceedings even after conviction and even in non-compoundable offences, where the parties have genuinely settled the matter between themselves. Such power must be exercised with circumspection, having regard to the nature and effect of the offence on society, seriousness of injury, voluntary nature of the compromise, and conduct of the accused before and after the offence. Offences not affecting the public at large or involving economic crime, contraband, or large-scale fraud may qualify for quashing on this basis.
