Hindu Marriage Act, 1955, S.13(1)(ia) -- Divorce -- Separate Rooms Within Same Premises as Part of Prolonged Discord -- Spouses occupying separate rooms in the same premises, standing alone, does not justify a finding of cruelty. Where such separation forms part of a prolonged matrimonial history marked by repeated disputes, allegations of abuse, an earlier matrimonial proceeding, failed reconciliation and continued estrangement, the cumulative effect of these circumstances establishes mental cruelty.
