Interim Injunction -- Object of Order XXXIX Rules 1 and 2 -- To preserve suit property and maintain status quo during pendency

(i) Civil Procedure Code, 1908, O.39 Rr.1, 2 -- Interim Injunction -- Object of Order XXXIX Rules 1 and 2 -- The object of these provisions is to preserve the suit property during pendency of proceedings and to maintain the existing state of affairs, so that any decree ultimately passed is not rendered ineffective, infructuous, or incapable of execution. (ii) Civil Procedure Code, 1908, O.39 Rr.1, 2 -- Interim Injunction -- Suit for Specific Performance -- Restraining the defendant from creating third party rights during pendency of a suit for specific performance prevents complication of the adjudicatory process and multiplicity of proceedings. An order granting such injunction cannot be termed arbitrary, capricious, or perverse so as to warrant interference.
