Expert Evidence -- Privately Engaged Expert -- Report of privately engaged expert can be filed in Court, subject to proof of relevancy and admissibility at trial

(i) Civil Procedure Code, 1908, O.26 Rr.9 & 10 -- Expert Evidence -- Privately Engaged Expert -- An expert can be engaged privately, without intervention of the Court, and the report of such expert can be filed in Court. Relevancy and admissibility of such report remain subject to proof and are to be determined at the stage of trial. (ii) Constitution of India, Art.227 -- Civil Revision -- New Plea of Fact -- A plea of fact cannot be raised for the first time in a civil revision petition filed under Article 227 of the Constitution.
