Bigamy -- Family Members of Accused Husband -- Section 495 IPC applies only to spouse who conceals prior marriage, not to family members absent conspiracy or abetment
(i) Indian Penal Code, 1860, S.494, S.495, S.496 -- Bigamy -- Family Members of Accused Husband -- Section 495 IPC is founded on Section 494 IPC and applies only to a person who contracts a subsequent marriage while concealing an earlier subsisting marriage from the new spouse. Section 496 IPC similarly applies only to the person who fraudulently goes through a marriage ceremony knowing no lawful marriage results. Neither provision contemplates liability of family members of the accused spouse, including parents or the first wife, unless such members themselves marry or conceal the earlier marriage.
