Divorce -- Non-Lodging of FIR by Wife -- Testimony of cruelty cannot be disbelieved merely for absence of FIR
(i) Special Marriage Act, 1954, S.27(1)(d) -- Divorce -- Non-Lodging of FIR by Wife -- Mere fact of non-institution of a formal First Information Report cannot by itself be treated as a ground to discredit testimony of cruelty and assault adduced by a wife -- Absence of FIR does not negate the credibility of her deposition where the circumstances otherwise support it. (ii) Special Marriage Act, 1954, S.27(1)(b) -- Divorce -- Desertion Following Cruelty -- Cruelty and desertion are inter-related -- Where cruelty is meted out to the wife and she is compelled to leave the matrimonial home as a result, her departure cannot be treated as wilful abandonment on her own volition.
