Suit for Declaration -- Unregistered Gift Deed -- Void ab initio -- No cause of action arises -- Plaint rejected under Order 7 Rule 11 CPC

(i) Specific Relief Act, 1963, S.34 -- Suit for Declaration -- Documents as Foundation of Litigation -- Documents form the very foundation of litigation and a suit for declaration must necessarily rest upon valid and legally enforceable documents. (ii) Transfer of Property Act, 1882, S.123 r/w Registration Act, 1908, Ss.17 and 49 -- Unregistered Gift Deed -- Void Ab Initio -- Inadmissibility in Evidence -- A suit for declaration founded upon an unregistered gift deed is a nullity in law, as such a document is void ab initio under S.123 of the Transfer of Property Act -- Such a document is further inadmissible in evidence under S.49 of the Registration Act, 1908. (iii) Civil Procedure Code, 1908, O.7 R.11(d) -- Rejection of Plaint -- Unregistered Gift Deed -- No Cause of Action -- Where a suit for declaration is founded upon an unregistered gift deed which is void ab initio, no valid cause of action can arise on the basis of such a document -- Plaint rejected.
