(i) Bharatiya Nyaya Sanhita, 2023, S.69 -- Sexual Intercourse by Deceitful Means -- Woman Accused -- Offence under this section is attracted only against a person capable of engaging in sexual intercourse by deceitful means -- Provision cannot be attracted against a woman -- Charge under this section against a woman co-accused is liable to be quashed. (ii) Code of Criminal Procedure, 1973, S.482 -- Quashing of Proceedings -- Partial Quashing Where Other Offences Alleged -- Where FIR discloses offences beyond the one found inapplicable, quashing may be granted only in respect of the inapplicable offence -- Investigation into remaining offences continues -- Charge sheet for continuing offence to follow findings of investigation.
