Revenue Authorities -- Jurisdiction to Decide Title -- Vested exclusively in Civil Court
(i) Revenue Law -- Revenue Authorities -- Jurisdiction to Decide Title -- Revenue authorities have no jurisdiction to decide title to land. Only a Civil Court has jurisdiction to decide title in favour of any person. (ii) Revenue Law -- Partition Proceedings -- Assertion of Title for Claiming Share -- Where a person has to assert title for claiming a share in land through partition, the revenue authority has no jurisdiction, as this requires evidence and proof that only a Civil Court can adjudicate. (iii) Madhya Pradesh Land Revenue Code, 1959, S.178 -- Partition of Holding -- Applicant Not Recorded as Bhumiswami -- A person who is not recorded as a Bhumiswami has no right to file an application for partition of holding under this provision.
