Removal from Roll of Advocates -- Fraudulent Document Furnished at Enrolment -- Removal requires fraud to be material to securing enrolment
(i) Advocates Act, 1961, S.26(1), Proviso -- Removal from Roll of Advocates -- Fraudulent Document Furnished at Enrolment -- Mere presence of a fraudulent document in the enrolment record cannot by itself be equated with obtaining enrolment by fraud -- Enquiry must further examine whether the fraud was connected with and had a bearing upon the person obtaining entry on the State Roll, that is, whether the person would not have obtained such entry but for the fraudulent act -- Where enrolment could have been secured even without the fraudulent document, the necessary nexus is absent and removal is not warranted.
