Railway Accident Compensation -- Absence of Ticket -- Does not negate status as bona fide passenger
Railways Act, 1989, S.124A -- Railway Accident Compensation -- Absence of Ticket -- Mere absence of a ticket on the person of a deceased or injured passenger cannot by itself defeat an otherwise credible claim of bona fide passenger status. Such a claim, supported by affidavit evidence, cannot be rejected only because no ticket was recovered. The provision is beneficial legislation and calls for liberal construction in favour of claimants.
