Production of Documents -- Court's Power at Any Stage of Suit -- Court can direct production of documents by any party at any time during pendency of suit

(i) Civil Procedure Code, 1908, O.7 R.14 -- Production of Documents -- Court's Power at Any Stage of Suit -- Order 7 Rule 14 CPC empowers the court, at any time during the pendency of a suit, to direct any party to produce upon oath any document in its possession or power. (ii) Civil Procedure Code, 1908, O.7 R.14 -- Production of Documents -- Direction to Produce Will at Appellate Stage -- An appeal being a continuation of the suit, the power to direct production of a document under Order 7 Rule 14 CPC can be exercised at the appellate stage as well. Where a photocopy of a document already stands filed in related proceedings, the appellate court may, after recording cogent reasons, direct the party in possession to produce the original along with details of where it was filed.
