Perjury -- Exaggeration of Husband's Income by Wife in Maintenance Proceedings -- No automatic action warranted
(i) Criminal Procedure Code, 1973, S.340 -- Perjury -- Exaggeration of Income of Husband -- Exaggeration of the income of the husband by a wife in proceedings under S.125 CrPC for the purpose of claiming maintenance does not by itself warrant initiation of action for perjury under S.340 CrPC. (ii) Criminal Procedure Code, 1973, S.340 -- Perjury -- Inquiry Under S.340 CrPC -- In every inquiry conducted under S.340 CrPC, the court is not bound to make a complaint regarding commission of an offence under S.195(1)(b) CrPC. The power is conditioned by the requirement that the court must be satisfied that it is expedient in the interests of justice to make such a complaint, and only upon such satisfaction may the court proceed to do so.
