NDPS -- Secret Information-- Delayed Compliance with Section 42 During Interception of Moving Vehicle -- Substantial compliance sufficient where information received in circumstances of urgency
Narcotic Drugs and Psychotropic Substances Act, 1985, S.42 -- NDPS --Secret Information-- Delayed Compliance with Section 42 During Interception of Moving Vehicle -- Requirements of recording information in writing and communicating it to a superior officer must be assessed in the context of urgency where information is received while an officer is on the move and calls for immediate action to prevent removal or destruction of contraband. Delayed compliance stands sufficiently explained by such exigency and does not vitiate the search where its substance is reduced to writing and communicated without prejudice to the accused.
