NDPS -- Financing Illicit Traffic -- Mere Receipt of Money Without Evidence of Channelisation -- Does not attract Section 27A
(i) Narcotic Drugs and Psychotropic Substances Act, 1985, S.27A -- NDPS -- Financing Illicit Traffic -- Mere Receipt of Money -- Financing illicit traffic under S.27A is distinct from mere receipt of money arising from a narcotics transaction -- Financing ordinarily means provision, investment, or channelisation of funds for facilitating illicit trafficking -- Mere receipt of money, without material showing its use for such financing, does not by itself satisfy S.27A. (ii) Narcotic Drugs and Psychotropic Substances Act, 1985, S.37 -- NDPS -- Cancellation of Bail -- Cancellation of bail is distinct from rejection of bail and requires cogent circumstances arising after the grant of bail, such as misuse of liberty, tampering with evidence, or absconding -- Re-appreciation of material already considered at the time of grant of bail is not a ground for cancellation.
