Juvenile Justice -- Juvenility Established After Trial as Adult -- Conviction on merits sustained but adult sentence set aside where accused proved juvenile at time of offence
(i) Juvenile Justice (Care and Protection of Children) Act, 2000, S.7A -- Juvenile Justice -- Juvenility Established After Trial as Adult -- Conviction on merits rendered by a regular criminal court need not be annulled merely because the accused was later found to be a juvenile on the date of offence. However, the adult sentence imposed by the regular court cannot survive once juvenility is established. (ii) Juvenile Justice (Care and Protection of Children) Act, 2000, S.19 -- Juvenile Justice -- Protection From Disqualification Attached to Conviction -- A juvenile whose conviction is sustained does not suffer any disqualification attached to conviction under another law. The Juvenile Justice Board must ensure compliance with consequential statutory requirements concerning records once juvenility is accepted.
