Inherent Powers -- Modification and Vacation of Interim Order -- Court may modify or vacate interim order suo motu without application by party

(i) Civil Procedure Code, 1908, S.151 -- Modification and Vacation of Interim Order -- Exercise of Inherent Powers -- A court is fully empowered to modify or vacate an interim order in exercise of its inherent powers whenever it deems fit -- Such power may be exercised even without any application by a party for that purpose. (ii) Civil Procedure Code, 1908, S.151 -- Wrong Provision of Law -- Erroneous Nomenclature -- An erroneous mention of a provision of law or nomenclature is of no consequence if the actual purport, subject matter, and reliefs prayed for are otherwise in consonance with law.
