Exclusion of Time -- Winding Up Proceedings -- Not available for suit for recovery of money
Limitation Act, 1963, S.14 -- Exclusion of Time -- Winding Up Proceedings -- Time spent pursuing winding up proceedings cannot be excluded while computing limitation for a suit for recovery of money. Exclusion under Section 14 applies only where the earlier proceeding was prosecuted in good faith for the same relief. A winding up petition, which may or may not enable recovery, seeks a relief distinct from recovery of money and its pendency does not extend limitation for a separate recovery suit.
