Evidence -- Disputed Signature or Handwriting -- Court can compare and conclude without expert examination

(i) Bharatiya Sakshya Adhiniyam, 2023, S.72 -- Evidence -- Disputed Signature or Handwriting -- It is the duty of the Court to compare the signature or writing and reach its own conclusion -- This duty cannot be avoided by stating that the Court is not an expert -- Opinion of a handwriting expert is not binding on the Court. (ii) Bharatiya Sakshya Adhiniyam, 2023, S.39 -- Expert Evidence -- Call for Handwriting Expert -- Power to call for expert evidence cannot be exercised routinely merely because a handwriting, signature or finger impression is disputed -- Discretion to call for expert opinion arises only where the Court has doubt, or the writing or impression is smudgy, vague or very light.
