Dowry Death -- Sentencing Discretion Under S.304B IPC -- Life imprisonment not an automatic consequence of conviction

(i) Indian Penal Code, 1860, S.304B -- Dowry Death -- Sentencing Discretion Under S.304B IPC -- Section 304B permits sentencing discretion between the statutory minimum of seven years and life imprisonment depending on facts of each case. Life imprisonment is not automatic upon conviction and the extreme punishment must be awarded only in rare cases, not as a routine, with reasons recorded by the trial court for imposing the maximum sentence. (ii) Indian Penal Code, 1860, S.304B -- Dowry Death -- Meaning of Soon Before Death -- The expression "soon before her death" is not to be interpreted in terms of days, months or years, but should indicate that the demand of dowry was not stale or a past aberration and remained a continuing cause for the death. A demand made within ten days of death satisfies this requirement. (iii) Indian Evidence Act, 1872, S.113B -- Dowry Death -- Presumption Under S.113B Evidence Act -- Once the foundational facts constituting dowry death are established by preponderance of possibility, the presumption of innocence is replaced by an assumption of guilt, shifting the burden to the accused to dislodge the presumption beyond reasonable doubt. Absence of any defence evidence to rebut this presumption sustains the conviction.
