Divorce by Mutual Consent -- Unconsummated Marriage -- Waiver of statutory period of one year justified
Hindu Marriage Act, 1955, Ss.13-B, 14 -- Divorce by Mutual Consent -- Unconsummated Marriage -- Where parties lived together for only about seven days after marriage and thereafter separated, the marriage remained unconsummated, no children were born out of the wedlock, and both parties have entered into a mutual settlement and unequivocally expressed their intention not to continue the matrimonial relationship, the statutory period of one year prescribed under S.14 is liable to be waived and the case is a fit one for entertaining the petition under S.13-B of the Act.
