Custody of Trap Money -- Complainant's Right to Restoration During Pendency of Trial -- Ownership of trap money vests in complainant, need not await conclusion of trial
Bharatiya Nagarik Suraksha Sanhita, 2023, S.497/503 -- Custody of Trap Money -- Complainant's Right to Restoration During Pendency of Trial -- Ownership of trap money remains with the de-facto complainant, who parts with his own funds to facilitate detection of corruption, and does not migrate to the State merely because the currency assumes the character of material evidence. Restoration through an equivalent amount from the exchequer may be effected, retaining the original notes as exhibits, without compelling the complainant to await conclusion of a prolonged trial.
