Cruelty to Wife -- Non-Communication for Thirteen Days -- Does not amount to cruelty under S.498A IPC

Indian Penal Code, 1860, S.498A -- Cruelty to Wife -- Non-Communication for Thirteen Days -- Refusal of a husband to speak to his wife for thirteen days does not fall within the meaning of cruelty under S.498A IPC. What constitutes mental cruelty depends on the facts and circumstances of each case and there is no fixed rule. Differences between spouses are a normal part of married life, and a period of non-communication, without more, does not cross the threshold of cruelty. Mere oral testimony and absence of WhatsApp messages are not sufficient to prove lack of communication.
