Cruelty -- Non-Consummation of Marriage -- Insufficient by itself to attract Section 498A IPC
(i) Indian Penal Code, 1860, S.498A -- Cruelty -- Non-Consummation of Marriage -- Non-consummation of marriage, without attendant acts of cruelty, cannot be converted into an offence under Section 498A IPC by adding embellished allegations. Such conduct may amount to cruelty under Section 12(1)(a) of the Hindu Marriage Act, 1956, but does not by itself satisfy the statutory ingredients of Section 498A IPC. (ii) Code of Criminal Procedure, 1973, S.482 -- Quashing of Proceedings -- Departmental Inquiry Founded on Criminal Case -- A departmental inquiry initiated solely on the basis of registration of a criminal case cannot survive independently once the criminal proceedings founding it are quashed as an abuse of process.
