Court Fee -- Petition for Letters of Administration -- Full court fee not payable at time of filing; only token amount required until application is allowed

Court Fees Act, 1870, Sch.II, Art.11 read with Sch.I, Succession Act, 1925, S.276 -- Court Fee -- Petition for Letters of Administration -- A petition seeking letters of administration under Section 276 of the Succession Act requires payment of only a token court fee of Rs.25 at the time of moving the application. Full court fee becomes payable only after the Court allows the application, and is deposited at the stage of actual issuance of the letter of administration. The petitioner cannot be directed to deposit the entire court fee at the filing stage itself.
