Contempt of Court -- Child Produced but Meeting Not Satisfactory -- No wilful disobedience of custody order
(i) Contempt of Courts Act, 1971, S.2(b) -- Contempt of Court -- Child Produced but Meeting Not Satisfactory -- Wilful disobedience of a court order is essential to constitute contempt -- Production of the child in compliance with the order negates wilful disobedience -- Dissatisfaction of a parent with the quality or effectiveness of the meeting does not by itself amount to contempt by the other parent. (ii) Hindu Marriage Act, 1955 -- Custody and Visitation -- Compulsion of Effective Meeting Between Parent and Child -- Child cannot be treated as a commodity who can be compelled or forced into an effective meeting with a parent -- Bonding between a parent and child has to be developed through nurturing by the parent, and cannot be achieved by compulsion through a court order.
