Anticipatory Bail -- Interim Protection from Arrest -- Does not bar filing of charge sheet
Criminal Procedure Code, 1973, S.438 -- Anticipatory Bail -- Interim Protection from Arrest -- An interim order directing that no coercive steps be taken against an accused protects only the liberty of the person seeking anticipatory bail. It does not restrain the Investigating Officer from filing a charge sheet on conclusion of investigation. Such interim protection means only that no arrest of the petitioner shall be made and does not prohibit the police from proceeding on the basis of evidence collected during investigation.
