Abetment of Suicide -- Administrative Reprimand by Superior Officer -- Ordinary disciplinary action does not amount to abetment absent proximate act of instigation
(i) Indian Penal Code, 1860, S.306 -- Abetment of Suicide -- Administrative Reprimand by Superior Officer -- Ordinary administrative directions, disciplinary supervision, adverse remarks on official performance or stern behaviour of a superior officer cannot, without additional material showing conscious intention to drive a subordinate to suicide, amount to abetment under Section 306 IPC. (ii) Indian Penal Code, 1860, S.107 -- Abetment of Suicide -- Essential Ingredients of Instigation -- Abetment of suicide requires direct or indirect instigation in close proximity to the commission of suicide, coupled with clear mens rea to abet the act. Continuous harassment culminating in suicide does not by itself establish instigation unless a proximate act immediately preceding the suicide is shown. (iii) Indian Penal Code, 1860, S.504 -- Abetment of Suicide -- Threat of Suspension by Officer Lacking Competent Authority -- Where the accused officer was not the competent authority to suspend the deceased without approval of a senior officer, an alleged threat of suspension does not establish intentional insult to provoke breach of peace or criminal intimidation.
